The Tuition Protection Service (TPS) held a student meeting for international students affected by the closure of the Cyneast Pty Ltd and Advanced Academy Pty Ltd (Oxford College) on Monday, 2 December 2019.

Cyneast Pty Ltd (00048F) and Advanced Academy Pty Ltd (02570E) - Administrator appointed

The Tuition Protection Service (TPS) has been advised that Cyneast Pty Ltd, trading as Oxford College and the Oxford College of English, and Advanced Academy Pty Ltd, trading as Oxford College, has engaged the services of Farnsworth Carson and entered voluntary administration on 25 November 2019. The Administrator has informed the TPS that Cyneast and Advanced Academy has ceased teaching students effective Wednesday 27 November 2019, and that Cyneast and Advanced Academy are not able to assist students.

The TPS will provide assistance to you to either continue your study with another provider or provide you a refund of your unspent tuition fees. The TPS hopes to hold student meetings in Sydney early in the week of 2 December 2019. The purpose of these meetings is to provide you information on assistance available from the TPS and the process to get this assistance. Please continue to check this website regularly and your emails for details of the student meetings.

ECA Graduate Institute Pty Ltd - Managed Closure

The TPS has been advised by ECA Graduate Institute Pty Ltd (RTO 91423, CRICOS 02997M) that they will close to international students and cease classes on Monday 5 November 2019.

ECA has informed the TPS that it intends to meet all of its obligations to international students under the Education Services for Overseas Students Act 2000 for this managed closure.

If you are an international student, ECA is required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Please contact ECA directly in the first instance. AGB Training - TPS Student Meeting

The Tuition Protection Service (TPS) is aware that the AGB Training (AGB) has closed and your studies have been disrupted. The TPS will assist you to ensure there is a minimal possible disruption to your studies. The TPS will hold a student meeting for international students affected by the closure of AGB on Monday 11 November 2019. The purpose of these meetings is to provide information on assistance available from the TPS for you to continue your studies with another provider.

Details for the student meetings for international students affected by the closure of AGB are as follows:

Registration: Commencing 11.00am

Meeting: Commencing 12.00pm

Location: Novotel Geelong, 10 - 14 Eastern Beach Road, Geelong, VIC

ABC Study Group Pty Ltd trading as the Australian International College of English

NOTICE FOR STUDENTS AND EDUCATION AGENTS

The Tuition Protection Service (TPS) is aware that ABC Study Group Pty Ltd trading as the Australian International College of English (AICE), is no longer able to continue to teach.

Next steps

The TPS has arranged for you to continue your studies at three providers listed below.

  • For students over the age of 18, students may choose one of the three providers listed below.
  • For students under the age of 18, the students will be placed at The Sydney College of English. The Sydney College of English is working with AICE to transfer any homestay and welfare arrangements.

Students or their guardians should contact the appropriate alternative provider as soon as possible to discuss placement. Students will not be transferred automatically.

Once students contact one of the schools below they will be enrolled and will be able to start studies immediately (Rapid Placement Process). Any unspent tuition fees will be transferred to one of the providers below that is chosen by you. Students will not have to pay for the course that has already been paid. Students will still need to pay fees for the part of the course that was not paid at AICE.

Please note the arrangement for Rapid Placement Process is only available at the three providers listed below.

If you do not wish to take up placement with the following providers, you will need to apply for a refund of unspent tuition fee, if any owed to you. please contact the TPS Administrator.

Australian Colleges of Further Education - Company Liqudiation (update)

The Tuition Protection Service (TPS) has been advised that Australian Colleges of Further Education (ACFE) has engaged the services of dVT Group and entered liquidation on 19 September 2019. dVT Group has been appointed the liquidator. The liquidator has informed the TPS that ACFE will not be meeting its obligations to students.

The TPS will provide assistance to you to either continue your study with another provider or provide you a refund of your unspent tuition fees. The TPS is planning on holding student meetings in Sydney and the Gold Coast in the week of 7 October 2019. The purpose of these meetings are to provide you information on assistance available from the TPS and the process to get this assistance. TPS Advisory Board - Draft advice and recommendations for the 2020 TPS Levy settings

On 31 July 2019, the TPS Advisory Board finalised its draft advice to the TPS Director regarding the settings for the 2020 TPS Levy. The draft levy settings - available here - propose changes to the risk factors: Payment in arrears; Length of operation; and Volatility in overseas student enrolments. The Board is not proposing changes to the other two risk factors or any change to the specified percentage rate (to remain at 0.07 percent).

The Board is proposing these changes to ensure the risk factors more closely align with the experience of provider failure.

In coming to its view, the Board considered the strategic risk environment, recent claims experience and the quantum of funds required to support the long-term sustainability of the Overseas Students Tuition Fund (OSTF).

The international education sector, including peak bodies and international education institutions, are invited to provide feedback and comments on the settings by Wednesday 2 October 2019 to operations@tps.gov.au. Any feedback will be considered by the TPS Advisory Board at its meeting scheduled for 23 October 2019.

The Tuition Protection Service (TPS) has been advised that Ad Astra Institute Pty Ltd (Ad Astra) has had its stay revoked by the Administrative Appeals Tribunal, and as a result had its CRICOS registration cancelled by the Australian Skills Quality Authority (ASQA). Ad Astra must cease teaching students with immediate effect.

If you are an international student, Ad Astra is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Ad Astra has until Wednesday 28 August 2019 to provide refunds or make alternative arrangements for the affected international students. If you have not been placed or refunded by 28 August 2019, please inform the TPS.

Murray College of Health Education Pty Ltd, t/a Murray College of Health Education and Murray College of Vocational Education Closure

The Tuition Protection Service (TPS) has been advised that Murray College of Health Education Pty Ltd, t/a Murray College of Health Education and Murray College of Vocational Education (Murray College), has had its CRICOS registration cancelled by the Australian Skills Quality Authority (ASQA). As a result, Murray College must cease teaching students with immediate effect.

If you are an international student, Murray College is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Murray College has until Friday 9 August 2019 to provide refunds or make alternative arrangements for the affected international students. If you have not been placed or refunded by 9 August 2019, please inform the TPS.

Nick Hannay Pty Ltd, t/a Hannay Accreditation

The Tuition Protection Service (TPS) has been advised that Nick Hannay Pty Ltd, trading as Hannay Accreditation (Nick Hannay), CRICOS Code 03463M, has had its Administrative Appeals Tribunal application for review dismissed, and as a result its CRICOS registration was cancelled by the Australian Skills Quality Authority (ASQA) effective 9 July 2019. As a result, Nick Hannay must cease teaching students effective immediately.

If you are an international student, Nick Hannay will be required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Nick Hannay has until Tuesday 23 July 2019 to provide refunds or make alternative arrangements for impacted international students. Nick Hannay has advised the TPS it intends to place all students with new providers. If you have not been placed by 23 July 2019, please inform the TPS. If you do not wish to accept a placement, Nick Hannay must provide you with a refund of unspent tuition fee.

Australian Colleges of Further Education - Visa Refusal Refunds

The Tuition Protection Service (TPS) is aware of a number of cases where the Australian Colleges of Further Education (ACFE), CRICOS Number 03327G, has not provided refunds for a number of students that have had their visas refused.

If you believe you are owed a refund from ACFE following your visa refusal and have not been contacted by the TPS previously, please contact the TPS at administrator@a.tps.gov.au or within Australia phone: 1300 980 434, outside Australia phone: +61 1300 980 434.

Please note affected students must contact the TPS directly, the TPS is not able to deal with education agents working on behalf of the students.

Australian National College - Cancellation of intending student CoEs

The TPS has been advised by the Australian Skills Quality Authority that Australian National College Pty Ltd (03009M) must cancel all Confirmations of Enrolments for all students intending to study at ANC but have not commenced, effective 3 July 2019, as part of a stay condition imposed by the Administrative Appeals Tribunal.

If you are an international student that has yet to commence, ANC is required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Please contact ANC directly in the first instance.

Western Senior Secondary College (WSSC) Closure

Western Institute of Technology Pty Ltd (WIT) is a dual sector provider of vocational education and training (VET) courses and senior secondary studies (02957G), trading as Western Senior Secondary College (WSSC) for its secondary studies.

WSSC ceased teaching international students from 28 June 2019. This only relates to WIT's secondary school operations. WIT's vocational education and training operations, trading under the same CRICOS registration, are not impacted by this managed closure.

If you are an international student, WSSC is required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Australian Vocational Learning Centre Pty Ltd

The Tuition Protection Service (TPS) has been advised that Australian Vocational Learning Centre Pty Ltd (AVLC) has engaged the services of Nicols + Brien and entered administration as of 4 June 2019. AVLC has ceased teaching students with immediate effect.

The TPS will provide assistance to you to either continue your study with another provider or provide you a refund of your unspent tuition fees.

The TPS will hold a student meeting in Parramatta for international students on Thursday 13 June 2019. Please continue to check this website regularly for details of the student meeting. This meeting will provide you with information on assistance available from the TPS and the process to get this assistance.

Information for students of Western Institute of Technology

The Tuition Protection Service has been informed that Western Institute of Technology has been unsuccessful in its appeal to the Administrative Appeals Tribunal, and must cease teaching Vocational Education and Training students effective 3 April 2019. This decision does not affect students of Western Senior Secondary College.

If you are an international student studying Vocational Education and Training courses, Western Institute of Technology is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Western Institute of Technology has until Thursday 18 April 2019 to provide refunds or make alternative arrangements for impacted international students.

BCA National Training Group Pty Ltd Closure

The Tuition Protection Service (TPS) has been advised that BCA National Training Group Pty Ltd (BCA) has engaged the services of PKF Australia and entered liquidation on 18 March 2019. PKF Sydney has been appointed the liquidator. BCA ceased teaching students today, 19 March 2019.

The TPS will provide assistance to you to either continue your study with another provider or provide you a refund of your unspent tuition fees.

The TPS plans to hold a student meeting in Darwin, Northern Territory on Friday 22 March 2019. A meeting for students in Sydney is planned on being held early in the week of 25 March 2019. The purpose of these meetings are to provide you information on assistance available from the TPS and the process to get this assistance. Merage Group Pty Ltd, t/a Merage Global Institute of Technology Closure

The Tuition Protection Service (TPS) has been advised that Merage Group Pty Ltd, trading as Merage Global Institute of Technology (Merage), has had its CRICOS registration cancelled by the Australian Skills Quality Authority (ASQA). As a result, Merage must cease teaching students with immediate effect.

If you are an international student, Merage is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Merage has until Tuesday 5 March 2019 to provide refunds or make alternative arrangements for impacted international students. Merage has told the TPS it intends to place all students with new providers. If you have not been placed by 5 March 2019, please inform the TPS.

Charlton Brown Pty Ltd - CRICOS Registration Expiry

The Tuition Protection Service is aware that the RTO registration of Charlton Brown Pty Ltd expired 31 December 2018. This means that Charlton Brown can continue to teach international students that commenced before 31 December 2018, but cannot allow any international student to start their studies after this date.

If you are a Charlton Brown international student that was due to commence after 31 December 2018, you should contact Charlton Brown directly for a refund of your prepaid tuition fees, or placement at a suitable alternative provider.

Fusion Business School Pty Ltd Closure

The Tuition Protection Service (TPS) has been advised that Fusion Business School (Fusion) has withdrawn its request for a stay against the Australian Skills Quality Authority (ASQA) decision to cancel the registration of Fusion. Fusion has ceased teaching students with immediate effect.

If you are an international student, Fusion is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Fusion has until Thursday 14 February 2019 to provide refunds or make alternative arrangements for impacted international students.

Nirvana Holdings Pty Ltd, trading as Health Institute Australia

The Tuition Protection Service (TPS) has been advised that Nirvana Holdings Pty Ltd, trading as Health Institute Australia did not renew its registration as a Registered Training Organisation with the Australian Skills and Quality Authority before the due date. As such, Health Institute Australia's RTO and CRICOS registrations ceased on 1 November 2018, and it must cease teaching domestic and international students with immediate effect.

Health Institute Australia is now required to provide refunds to all impacted international students. Health Institute Australia has until Monday 14 January 2019 to provide refunds or make alternative arrangements for impacted international students.

The Tuition Protection Service (TPS) has been advised that AGB Group Pty Ltd has entered voluntary administration on Friday 19 October 2018. At this stage, the administrator has informed the TPS that training to students continues to be provided.

Fusion Business School Pty Ltd

The Tuition Protection Service (TPS) has been advised that the Australian Skills Quality Authority (ASQA) has made a decision to suspend the registration of Fusion Business School Pty Ltd ("Fusion") effective from 19 October 2018.

This suspension means that Fusion is unable to deliver courses to overseas students (either on or offshore) where the student's enrolment/course is yet to commence. Eg. All future enrolments (CoEs) will be cancelled. Fusion can however continue to teach current course of studies, which have already commenced prior to 19 October 2018.

If you have any questions regarding the continuation of your studies or how to apply for a refund of your tuition fees for your cancelled enrolment, we recommend that you speak with Fusion in the first instance.

Charlton Brown

The TPS has been advised that Charlton Brown (02476C) is in the process of being sold to a new education provider.

Prior to this sale negotiation an Administrator (Grant Thornton Australia Limited) was appointed and asked students to complete the form "Form 535 Formal Proof of Debt or Claim (General Form)" on 19 September 2018.

Please be advised that as there is a high likelihood of the sale being completed and your studies continuing under the new provider as usual, you are advised at this stage to take no action in respect of "Form 535 Formal Proof of Debt or Claim (General Form)".

During this time students are encouraged to continue to attend classes and check their emails regularly for further updates from Charlton Brown.

Australian Higher Education Services Pty Ltd T/A Sydney College of Business and Information Technology

The Tuition Protection Service (TPS) has been advised that Australian Higher Education Services Pty Ltd T/A Sydney College of Business and Information Technology (SCBIT) has ceased teaching courses to its international students effective from Thursday 23 August 2018.

SCBIT has advised that they are providing assistance to students by transferring them to another provider immediately. The TPS recommends that students of the college make contact with SCBIT initially to ensure a timely transfer. As part of the transfer to another provider, SCBIT is also required to transfer your unspent fees, if there are any, to your new provider.

Technical Education Australia Pty Ltd T/A Hospitality Management Institute of Australia and Business College of Australia

The Tuition Protection Service (TPS) is aware that the Administrative Appeals Tribunal has revoked a stay order granted to Technical Education Australia (TEA) Pty Ltd. As a result, TEA's registration both as a RTO and CRICOS provider was cancelled by the Australian Skills and Quality Authority (ASQA), effective from 24 August 2018. TEA cannot continue to teach international students with immediate effect.

If you are an international student, TEA is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. If you have any questions about transition arrangements and/or continuation of your studies, please talk to TEA in the first instance. If you have any questions, you can contact the TPS.

In the event that TEA does not assist with your transfer or refund, the TPS will assist you to continue your studies with an alternate provider. TPS to expand

The Australian Government is expanding the successful Tuition Protection Service (TPS) for international students to provide tuition assurance for students with VET Student Loans (VSL) providers and non-university higher education providers (NUHEP) offering FEE-HELP. The new tuition assurance arrangements, for VSL and NUHEP FEE-HELP, will commence on 1 January 2019. Non-exempt providers will be required to pay levies, commensurate with their size and risk.

The current TPS arrangement will continue as a dedicated service for international students, with its own quarantined account and the same protections and support through placements and refunds. Consistent with the TPS, the new arrangements will be managed by a statutory appointed Director, who will be supported by an independent Advisory Board. Q: Will the TPS change?

The current TPS arrangements will continue as a dedicated service for international students, with its own quarantined account and the same protections and support through placements and refunds. The TPS levies for the Overseas Student Tuition Fund will not change as a result of the new tuition assurance arrangements and will not be used to cross subsidise the new tuition assurance arrangements for VSL and NUHEP FEE-HELP.

The functions of the TPS Director and Advisory Board will be expanded to encompass both the overseas and domestic (VSL and NUHEP) students' tuition assurance arrangements.

Q: What does this mean for tuition assurance for the remainder of 2018?

The current interim tuition assurance arrangements will remain in place until 31 December 2018. This will allow the Government sufficient time to implement the new arrangements for 1 January 2019, and allows the sector to be consulted on the new model.

Australian College of Vocational Studies Pty Ltd t/a Vocational Study Australia (ACVS)

The Tuition Protection Service (TPS) has been advised that Vocational Study Australia has ceased teaching courses to its international students effective from Friday 4 May 2018.

ACVS has advised that they are providing assistance to students by transferring them to another provider immediately. The TPS recommends that students of the college make contact with ACVS initially to ensure a timely transfer. As part of the transfer to another provider, ACVS is also required to transfer your unspent fees, if there are any, to your new provider.

ESOS Refund Calculations Instrument

The Education Services for Overseas Students (Calculation of Refund) Specification 2014 (refund specification) takes effect from 1 July 2014. The refund specification is available on the Federal Register of Legislation website. This refund specification combines the previous two legislative instruments that were in operation. The refund specification is simpler and more clearly articulates refund calculations in cases of visa refusal and where there is no compliant written agreement between the education provider and the student.
