Closure of EC English Australia Pty Ltd [03812F]

The Tuition Protection Service (TPS) has been advised that EC English Australia Pty Limited has entered liquidation and ceased teaching its international students on Wednesday 24 March 2021. TPH Advisory has been appointed as the liquidator.

It is understood that all students who were currently studying with EC English at the time of its closure have been placed in suitable alternative arrangements with another provider to continue their studies.

For those students who have paid tuition fees to EC English but are still yet to commence, the TPS has worked closely with the liquidator and EC English to transfer your enrolment to an alternative provider. The alternative providers are:

Your prepaid tuition fee has also been transferred to your relevant provider.

If you have not already done so, please contact the alternative provider in your intended location in the first instance to finalise your enrolment. Please note if you finalise your placements with nominated providers, you will not have to pay any enrolment fee or any other administrative fees.

Bridge Business College - Student Refunds update

The TPS is aware that while there are students who have been refunded, there are a few students who have not been refunded to date. Please continue to be patient as the payments continue to be processed.

However, if you have any concerns or if you believe you are owed a refund, but have not been contacted, please contact the TPS Administrator on 1300 980 434 or via email at administrator@a.tps.gov.au.

Bridge Business College - Student Refunds

The TPS has been advised by Bridge Business College's (CRICOS Code 01107C) administrator, Hall Chadwick, that refunds to international students will be paid commencing on 5 September 2020. The TPS is aware that while there are students who have been refunded, there are still a number of students who have not been refunded to date. Please continue to be patient as Bridge Business College continues to process payments.

Closure of Bridge Business College (01107C) and Alternative Providers

Bridge Business College (CRICOS Code 01107C) ceased trading on 22 May 2020. The TPS is aware that Bridge Business College is meeting its obligations to students, as required under the ESOS Act, by offering refunds of unspent tuition fees. Bridge Business College has written to all affected students and education agents, and students are encouraged to seek refunds directly from the college. The TPS is in regular contact with Bridge Business College to monitor the refund processing to students.

Alternative provider

Students can choose to continue their studies with a provider of their choice. Some possible alternative providers with course offerings similar or same as Bridge Business College is provided below. Students are advised to consult the providers' website to get more information about courses offered and information on the course structure and fee etc.

Closure of Management School Sydney - MSS Education Pty Ltd (03485E)

MSS Education Pty Ltd (CRICOS Code 03485E) ceased trading on 18 May 2020. MSS has advised the TPS that it is taking steps to meet its obligations to students and will either place students with alternative providers or will provide students with refunds for unspent tuition fees.

The TPS understands that the current COVID-19 situation may be concerning for some students and providers. Providers and students are encouraged stay up-to-date on current advice, and consider flexible approaches to support the continuity of education and training delivery.

COVID-19 Restrictions

The Tuition Protection Service (TPS) is mindful that international students and education providers are impacted by the restrictions on travel and other social distancing measures following the COVID-19 outbreak.

International Students

Currently it is unsure of how long these restrictions will continue. If you have been impacted by the travel restrictions please contact your provider as soon as possible. It is important that you notify your provider of your current situation and work with them on achieving a satisfactory solution, such as deferment or postponement of your studies instead of cancelling your studies altogether. If your studies are impacted by social distancing measures, please discuss your options and matters of concern with your provider.

If you are a Year 11 or 12 student studying in a CRICOS registered school, you may be eligible to apply for a travel ban exemption. Please contact your school for further details. Factsheets on this exemption can be found here, Chinese version here.

Providers

The TPS requests that providers consider the best interests of the students when receiving deferral and refund requests from students impacted by Coronavirus travel restrictions. This includes consideration of refunds in cases where the provider may otherwise not be required to pay a refund under the student agreement. If you are impacted by social distancing measures, for example, counselling, postponing classes, or changing the delivery mode of the study, please do discuss options with the students and inform the TPS of the steps being taking by you.

Students Affected by Coronavirus Restrictions on Travel

The Tuition Protection Service (TPS) is aware that international students may be impacted by the restrictions on travel imposed following the Coronavirus outbreak in China. The TPS has the following advice:

For students

  • If you are unable to travel, please contact your provider as soon as possible. When informing your provider, please be clear whether you are postponing your studies or cancelling your studies.

  • If you have recently returned from China, please review the advice from the Australian Government Department of Health and discuss your return to study with your provider.

For providers

Australian Colleges of Further Education - Company Liqudiation (update)

The Tuition Protection Service (TPS) has been advised that Australian Colleges of Further Education (ACFE) has engaged the services of dVT Group and entered liquidation on 19 September 2019. dVT Group has been appointed the liquidator. The liquidator has informed the TPS that ACFE will not be meeting its obligations to students.

The TPS will provide assistance to you to either continue your study with another provider or provide you a refund of your unspent tuition fees. The TPS is planning on holding student meetings in Sydney and the Gold Coast in the week of 7 October 2019. The purpose of these meetings are to provide you information on assistance available from the TPS and the process to get this assistance. Please continue to check this website regularly for details of the student meetings. The Tuition Protection Service (TPS) is aware that VIN International Pty Ltd, trading as the Institute of Business, Sydney (IBS), had its CRICOS registration cancelled by the Australian Skills Quality Authority (ASQA) on 22 August 2019.

Ad Astra Presentations and Alternative Providers

The Tuition Protection Service (TPS) held a student meeting for international students affected by the closure of the Ad Astra Institute Pty Ltd (Ad Astra) on Monday, 26 August 2019.

TPS system available

The Tuition Protection Service (TPS) has opened access to the TPS online system for international students affected by the closure of Ad Astra. Students should receive an email from the TPS Administrator inviting them to log into the TPS system. Ad Astra Institute Pty Ltd Closure

The Tuition Protection Service (TPS) has been advised that Ad Astra Institute Pty Ltd (Ad Astra) has had its stay revoked by the Administrative Appeals Tribunal, and as a result had its CRICOS registration cancelled by the Australian Skills Quality Authority (ASQA). Ad Astra must cease teaching students with immediate effect.

If you are an international student, Ad Astra is now required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Ad Astra has until Wednesday 28 August 2019 to provide refunds or make alternative arrangements for the affected international students. If you have not been placed or refunded by 28 August 2019, please inform the TPS.

Nick Hannay Pty Ltd, t/a Hannay Accreditation

The Tuition Protection Service (TPS) has been advised that Nick Hannay Pty Ltd, trading as Hannay Accreditation (Nick Hannay), CRICOS Code 03463M, has had its Administrative Appeals Tribunal application for review dismissed, and as a result its CRICOS registration was cancelled by the Australian Skills Quality Authority (ASQA) effective 9 July 2019. As a result, Nick Hannay must cease teaching students effective immediately.

If you are an international student, Nick Hannay will be required to arrange your transfer to another education provider or to provide you a refund of your unspent tuition fee. Nick Hannay has until Tuesday 23 July 2019 to provide refunds or make alternative arrangements for impacted international students. Nick Hannay has advised the TPS it intends to place all students with new providers. If you have not been placed by 23 July 2019, please inform the TPS. If you do not wish to accept a placement, Nick Hannay must provide you with a refund of unspent tuition fee.

Australian Colleges of Further Education - Visa Refusal Refunds

The Tuition Protection Service (TPS) is aware of a number of cases where the Australian Colleges of Further Education (ACFE), CRICOS Number 03327G, has not provided refunds for a number of students that have had their visas refused.

If you believe you are owed a refund from ACFE following your visa refusal and have not been contacted by the TPS previously, please contact the TPS at administrator@a.tps.gov.au or within Australia phone: 1300 980 434, outside Australia phone: +61 1300 980 434.

Please note affected students must contact the TPS directly, the TPS is not able to deal with education agents working on behalf of the students.

Charlton Brown

The TPS has been advised that Charlton Brown (02476C) is in the process of being sold to a new education provider.

Prior to this sale negotiation an Administrator (Grant Thornton Australia Limited) was appointed and asked students to complete the form "Form 535 Formal Proof of Debt or Claim (General Form)" on 19 September 2018.

Please be advised that as there is a high likelihood of the sale being completed and your studies continuing under the new provider as usual, you are advised at this stage to take no action in respect of "Form 535 Formal Proof of Debt or Claim (General Form)".

During this time students are encouraged to continue to attend classes and check their emails regularly for further updates from Charlton Brown.

ESOS Refund Calculations Instrument

The Education Services for Overseas Students (Calculation of Refund) Specification 2014 (refund specification) takes effect from 1 July 2014. The refund specification is available on the Federal Register of Legislation website. This refund specification combines the previous two legislative instruments that were in operation. The refund specification is simpler and more clearly articulates refund calculations in cases of visa refusal and where there is no compliant written agreement between the education provider and the student.

The official explanatory memorandum is available on the Federal Register of Legislation website. A fact sheet has also been developed to assist providers in understanding the amendments.
